WHAT TYPE OF PERSONAL INFORMATION DOES TRADE COOLIFE?

Coolife may collect the following personal information from users of the Coolife website and/or Coolife mobile application (“WEB/APP”) through the appropriate forms: name, email address, postal address, phone number, date of birth, gender and credit card (PAN+CVV2) in compliance with PCI DSS standards or account number (provided by the customer in case of return), when the user visits the WEB/APP, registers, places an online order, contacts Coolife or participates in Coolife promotions or surveys.
Coolife also collects all information related to your browsing on the WEB/APP and your interaction with the brand.
All personal data collected by Coolife comes from the data subject, with the exception of contact information that may be provided to us by friends or family members:
- To send a gift voucher or other gift.
- To share favourites saved on the WEB/APP.

WHY DO WE PROCESS PERSONAL DATA?

The personal data of the data subject will be processed for the following purposes, as applicable:
- Manage and develop the register on the WEB/APP. Registration will involve the profiling of the users WEB/APP browsing.
This profiling consists of the use of the customer’s personal data and browsing information such as the products viewed or added to the basket, the sections of the WEB/APP visited, the location to access their preferences and/or personal interests in order to offer them WEB/APP content, offers, services and products appropriate to their profile.
- Manage and develop online sales. We use the customer’s personal information to process and deliver your order and inform you by email and/or SMS of the status of your order.
- Manage and send information about exclusive promotions, latest news and personalised information tailored to the profile, interests and needs of the person concerned as a customer, via email, SMS or postal mail. The sending of this information will involve the profiling of users, consisting of using personal data, the history of their purchases if applicable, in addition to browsing information on the WEB/APP to evaluate certain aspects related to their personal preferences in order to offer commercial communication tailored to their profile.
- The content, products or services will be personalised to the customer according to their interests. To manage communications, see the ‘Subscriptions’ section in My Account. - Manage the alert service for when a particular item of clothing is available on the WEB/APP.
-Manage and issue sales documents: digital receipt, sales invoice or TAX FREE.
- Manage the WIFI service in Coolife stores.

HOW LONG WILL WE RETAIN THE DATA?

Coolife will save the personal data for no longer than the period of time deemed necessary, taking into account the needs to respond to issues that arise or resolve problems, making improvements, activating its services and complying with requirements under applicable law. This means that it may retain personal data for a reasonable period of time even after the data subject has stopped using the TRADE NAME services or has stopped using the WEB/APP. After this period, the personal data will be blocked from all Coolife systems.

WHAT LEGITIMISES US TO PROCESS THE DATA?

Coolife has the following legitimate grounds to be able to process personal data: Execution of the contract. The legal basis for the processing of the personal data of the data subject that is collected is the execution of the purchase contract. In this regard, the data subject is obliged to provide the data that are necessary for its execution. If this data is not provided, it will not be possible to carry out the purchase-sale.
Legal obligations. The management and issuance of the sales invoice is based on the legal obligation of Coolife in its relationship with customers.
Consent. In relation to the following purposes, the legal basis for the processing of the personal data of the data subject will be the consent of the data subject, if given:
- Management of the registration of the WEB/APP.
- Management of sending information about exclusive promotions, latest news and personalised information tailored to the profile of the interested party.
- Management of the item availability alert service on the WEB/APP.
-Management and issue sales documents: digital receipt, sales invoice or TAX FREE.

The withdrawal of consent to this processing by the interested party will not condition the execution of the purchase contract concluded between the latter and Coolife.

Legitimate interest. In relation to the following purposes, the legal basis for the processing of the personal data of the data subject will be the legitimate interest of Coolife:
- Profiling through navigation on the WEB/APP by a registered user, as well as all users who have provided us with their data for any other purpose.
- The creation of profiles to send information about exclusive promotions, latest news and personalised information tailored to the profile of the interested party.
-Sending satisfaction surveys on products purchased or services used by Coolife customers to request their opinion and to improve them.

Our legitimate interest is to ensure that our WEB/APP remains secure, as well as to help Coolife to understand the needs, expectations and level of satisfaction of users and, therefore, improve services, products and brands. All these actions are carried out in order to improve the level of customer satisfaction and ensure a unique browsing and shopping experience.

TO WHICH RECIPIENTS MAY WE COMMUNICATION THE DATA?

The personal data of the data subject may be transferred/communicated to the following recipients:
- Coolife Group companies.
- Public Administrations and Public Bodies when required by tax, labour, Social Security or any other applicable regulations.
- Companies responsible for data processing, such as franchisees and supplies that provide services to Coolife (courier companies, companies sending communications, agencies, profiling companies, etc.).

International transfers of data may also occur in the context of the above transfers/communications for which Coolife will use the Standard Contractual Clauses adapted by the European Commission and the EU-US Privacy Shield as guarantee for those transfers made to countries that do not have an adequacy decision from the European Commission. In any case, third parties with whom certain personal data is shared will have previously accredited the adoption of adequate technical and organisational measures for their correct protection.
In no case does TRADE NAME sell customer data to third parties.

HOW DOES TRADE NAME PROTECT PERSONAL DATA?

The WEB/APP uses information security techniques such as firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorised access to data and ensure their confidentiality. To achieve these purposes, the user agrees that TRADE NAME obtain the data for the purpose of authentication of access controls. Additionally, any transaction made through the WEB/APP is carried out through secure payment systems. Confidential payment data is transmitted directly and encrypted (SSL) to the corresponding entity.

Coolife declares that it has adopted all the necessary technical and organisational measures to ensure the security and integrity of personal data processed, in addition to preventing loss, alteration and / or access by unauthorised third parties.

USE OF OUR WEBSITE

The user agrees to make proper use of the contents of the Website, being obliged to (i) provide truthful and accurate information about the data requested in the registration form or order form, and keep them updated, every time you use the Web; (ii) not to engage in illicit, illegal or contrary to good faith and public order; (iii) not to disseminate content or propaganda of a racist, xenophobic or discriminatory nature based on race, sex, ideology, religion or that in any way violates morality, public order, fundamental rights, public freedoms, honour, privacy or the image of third parties and, in general, current legislation; (iv) not to cause damage to the physical and logical systems of the Web, Coolife suppliers or third parties, or introduce or spread in the network computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage; (v) not to use the contents of the Web and the information of the same to send advertising, or send messages with any other commercial purpose, or to collect or store personal data of third parties; (vi) do not attempt to access and, where appropriate, use the email accounts of other users and modify or manipulate their messages.

Coolife reserves the right to undertake any modifications to its Web it deems necessary, with no prior warning, and may change, delete or add both content and services offered via this Web or the way in which these are presented or located in its portal.

INTELLECTUAL AND INDUSTRIAL PROPERTY

All intellectual and industrial property rights of the Web and its content, including but not limited to images, sound, audio, video, design, texts, graphics, logos, icons, colour combinations, structure and buttons, in addition to software, trade names, brands, trademarks, works, illustrations, photographs or industrial drawings and any other signs susceptible of industrial and commercial use are property and ownership of Coolife or third party owners who have duly authorised their inclusion on the Web.

The reproduction, distribution and public communication, including the mode of making available, of all or part of the contents of the Web, for commercial purposes, in any form and by any technical means, without the authorisation of N Coolife is expressly prohibited. Coolife is not responsible, in any case, for damages of any kind that may occur, but not limited to: errors or omissions in the content, lack of availability of the portal or transmission of viruses or malicious or harmful programmes in the content, despite having taken all the necessary technological measures to prevent it.
It is possible that the client’s website redirects to content on third party websites. As the provider cannot always control the content posted by third parties on their websites, it does not assume any responsibility for such content. In any case, the provider states that it will proceed to immediately remove any content that could violate national or international law, morality or public order, proceeding to the immediate withdrawal of the redirection to said website, informing the competent authorities of the content in question.
Coolife is not responsible for the information and content stored, including but not limited to, forums, chats, blog generators, comments, social networks or any other means that allows third parties to publish content independently on the Web. However, Coolife is available to all users, authorities and security forces, and actively collaborates in the removal or blocking of all content that could affect or contravene national or international legislation, rights of third parties or morality and public order. In the event that the user considers that there is any content on the Web that could be susceptible to this classification, please notify the Web administrator immediately.
The Web has been reviewed at tested to ensure that it works correctly. In principle, it can be guaranteed to work properly 24 hours a day, 7 days a week, all year round. However, Coolife does not rule out the possibility that there may be certain programming errors, or that occur due to force majeure, natural disasters, strikes, or similar circumstances that make it impossible to access the Web.
The introduction of hyperlinks for commercial purposes is prohibited on websites outside Coolife that allow access to the Web, without the prior use of Coolife. Coolife is not responsible for the use or content of third part websites that may link to coolife.es.

USE OF COOKIES

WHAT ARE COOKIES AND HOW DOES TRADE COOLIFE THEM?

COOLIFE, on its own or a third party, contracted to provide measurement services, may use cookies when a user browses the Web. Cookies are files sent to the browser by a web server in order to record user activities during their browsing time.
By way of the use of cookies it is possible that the server where the web is located, recognises the web browser used by the user in order to facilitate navigation, allowing, for example, access to users who have registered previously, access to areas, services, promotions or competitions reserved exclusively for them without having to register each visit. HOW DOES COOLIFE COLLECT AND USE IP ADDRESSES?

The Web servers may automatically detect the IP addresses and domain name used by the users.
